Oprah and Dr. Oz File Lawsuit

Apparently, Oprah Windfrey and Dr. Oz have filed suit against companies for using their names in their marketing campaigns, web page addresses, etc. The article sites FWM Marketing as the lead defendant. Their products include names like ResV, ResVultra, ResVmax, ResVpure, etc.  There are many negative web pages on these products about fraud, etc.

From the New York Post newspaper, 8/20/09: OUTRAGED OPRAH SUES OVER CURE-IOUS WEB CLAIMS

Oprah Winfrey and her favorite physician, “Dr. Oz,” filed suit yesterday to shut down more than 500 Web sites that falsely claim the pair endorses the sites’ diet pills and miracle cures.

Winfrey and celebrity surgeon Dr. Mehmet Oz claim in court papers that many of the sites are actually “credit card scams or other fraudulent schemes” that con customers into costly subscriptions to their dubious products.

The concoctions “purport to be dietary supplements, such as for ‘resveratrol,’ ‘acai berry’ and colon cleansing; cosmetics, such as cellulite and anti-wrinkle creams; and/or over-the-counter drugs, such as tooth-whitening products,” the suit says.

They’re sold on Web sites with names including “oprahsnewdiet.com,” “oprahhealthoffers.com” and “drozadvice.com.”

… Lead defendant FWM Laboratories of Hollywood, Fla., didn’t reply to an e-mail seeking comment.

Wow !!!

Vinomis has been targeted by this company too, but simply don’t have the funds or time resources to file a legal suit. Our name in their ads. Our blog and web page content to divert people to their websites. They’ve given out FREE bottles with no cost — until you read the fine print and get charged up to $85 per month, etc. etc.

But, Vinomis plowed forward, taking the high-road in the hopes that we, and other fair competitors, would prevail.

We’ll have to wait and see what happens with this law suit … stay tuned.

Should your company use Social Networking?

Actually, the answer is unclear, and “it depends”.

Vinomis has decided to use social networking selectively as follows:

1. Blogs

Definitely this is our best social networking ongoing project. Our blogs (we maintain 3 of them) keep an ongoing conversation with our customers and stakeholders. We can express our opinions about Resveratrol and red wine grape extracts, talk about dosages, talk about industry news, company announcement, etc. Don’t forget that Commenting on other people’s and company’s blogs is also a good idea, and part of true social networking.

2. Twitter

Instead of trying to get 10,000s of followers, we’re getting higher “quality” followers who are doctors, medical practitioners, pharmacists, and customers who would benefit from our product — diabetics, athletes (especially endurance athletes), etc.

Then we Tweet regularly (at least 2-3 times a day) with news, product updates, special offers (which we can track directly back to Twitter — i.e. http://www.vinomis.com/twitter1 )  The verdict is still out on the effectiveness of this, but it takes only a few minutes a day to maintain.

3. Plaxo, Linked In, etc.

We do use these tools to maintain our personal friend and associate databases and contacts. We contact these people and tell them about Vinomis as they are interested in what their “friends” are doing. We give them a special Friends and Family code for discounts off our products. We track each Friends and Family code to see results.

3. MySpace and FaceBook

Vinomis has decided NOT to use MySpace and FaceBook for one simple reason — time. In past companies, I have put up these pages successfully, but as soon as we stopped posting and replying, etc. every day, they died on the vine. We just don’t have the time to use these tools effectively.

Whatever you do, measure your results, to see what’s working and what’s not.

6 Rules of Blogging

I have been blogging for about 5 years since about 2004 while at TalkShoe. My blogs have been for companies, for my courses at Carnegie Mellon University and for personal use. My blogs have been read by over 100,000 people. Over the years, I have learned several key elements of good blogging.

1. Use your own Domain

I just learned this recently (we’re always learning) that blogging using a public service like Wordpress can be dangerous. On our our competitors, who shall remain nameless (for now) contacted Wordpress and said we were violating their agreements. Poppycock. We simply mentioned a competitors name which is allowed under numerous competitive laws (i.e. Coke vs Pepsi, Windows vs. Mac, etc.) But that doesn’t matter. Wordpress shut us down, and despite numerous emails, would not reinstate our blog. Not to worry, we just put our blog under our own domain. You can easily do this with .Mac and many other websites that will host your blog for free.

2. Tell the Truth

People will see through the marketing hype, and other untruths. This is the same advice given to writers of memoirs, autobiographies, etc.

3. Blog Frequently

Nobody wants to read yesterday’s news. Blog what you’re thinking now. Make it topical. 

4. Don’t Only Blog About Yourself

Include links to other blogs, websites, and content on the Internet. The more links outbound and inbound, the higher the rankings on Google, Yahoo, and others.

5. Use Tags, keywords, etc.

The Internet search engines are based upon keywords. If you just write about your topic freely, you will naturally include many keywords. Remember to include tags to your blog posts, which are again just keywords.

6. Find Your Voice

Don’t try to become a writer. If you’re blogging, you already are a writer. Use your own “voice”. Write like you talk. There was only one Shakespeare, and he probably wouldn’t have had a popular blog anyway :-)

Vindure 900 Formulation

Formulating a nutraceutical product like Vindure may seem straightforward, but it is very complex. Among the factors that must be considered are:

  • Ingredient selection
  • Ingredient quality
  • Proven ingredients in human clinical trials
  • Proven scientific data
  • Cost
  • Pricing

Vindure 900 has the highest concentration of red wine grape extracts and Resveratrol on the market today. That was our goal. We sought to become the highest quality vendor in the market place. Most of our founders and financiers are doctors, and they wanted the best product for their patients. The rest of us are avid researchers of longevity, age related illnesses, and overall wellness. The question was simple, “what formulation would we take on a daily basis”

The first hurdle was quantity. We quickly discovered that the maximum dosage possible in a single capsule or tablet was 1,000 mg (1 gram). Any more than that would require multiple tablets/capsules, or a size that was too large for the average consumer.

We also researched the scientific studies on Red wine grape extract and Resveratrol. Xenomis had been involved in one of the world’s first human clinical trials on this subject, and used a formulation of 400 mg 98% pure resveratrol, 400 mg Red wine grape extract, and 100 mg of Quercetin for bioavailability. That was our starting point, as we understood the scientific efficacy and benefits of this formulation.

Next we looked at Resveratrol, which is generally available in purity levels of 20%, 50%, and 98% purity. Of course, the cost increases dramatically with increased purity. We decided on the 98% purity ingredient, again, because it’s what we wanted to give our patients and ourselves. The real issues isn’t the purity, it’s what’s UN-pure. For 50% purity Resveratrol, indeed 50% is not Resveratrol, and not pure. We wouldn’t put that in our bodies.

A separate study was underway at Marywood University with Dr. James Smoliga, with 400 mg of Red Wine grape extract. This study had experienced positive results for athletes in terms of strength, endurance, cognition and memory. 

Consumers also had to be able to afford to take Vindure on a daily and monthly level. We chose a price of $39.95 because that was the level at which consumers could afford a high quality nutraceutical supplement product.

And so, Vindure 900 was born, the world’s highest concentration of Red Wine grape extracts and Resveratrol on the market today.

My Story of Vinomis and Resveratrol

The story of Vinomis must start with anti-aging, longevity, and Resveratrol. Personally, I had been researching aging for many years, as an interest in living longer and healthier, and as a scientific endeavor.

Separately, Dr. Joseph Maroon of University of Pittsburgh Medical School (UPMC) was researching ant-aging and the benefits of red wine grapes and Resveratrol for his neurological patients. Dr. Maroon is the Chief of Neurosurgery at UPMC, and team doctor for the world champion Pittsburgh Steelers. Dr. Maroon found his way to Australia, California and France in his quest. 

He also crossed paths with Dr. David Sinclair and Dr. Joseph Baur who were doing research in the area of Calorie Restriction, SIRT genes and enzymes, Resveratrol and red wine grape polyphenols. These researchers had discovered that 19 compounds, 17 of which are found in red wine grapes, can mimic the longevity effects and anti-age related disease effects of calorie restriction. Resveratrol and Quercetin were found to be the two most potent red win grape polyphenols.

Again separately, Dr. Bryan Donohue, Chief of Cardiology at UPMC Shadyside, was investigating the same subject. At a cocktail party at my friend Dr. Lenny Ganz’s house, Bryan and I spend two (2) hours discussing Resveratrol. I have a charitable foundation, and was interested in funding research in this area.

Dr. Maroon, had hooked up with Bill Watts (ex-CEO of GNC) and David Sculley (ex-CEO of Heinz USA) and formed a company called Xenomis. Working with Harvard Medical School, they had obtained an the first exclusive license granted by Harvard for a patent in proprietary science for Xenohormesis (plant extracts) and Resveratrol. 

Bryan introduced me to Joe Maroon at my house in Sewickley, and we discussed my funding Resveratrol research. What I hadn’t counted on was that they were seeking a business partner for Xenomis, who specialized in marketing — that would be me !

I subsequently joined Xenomis as a partner, and Dr. Donohue later joined the company.

In December of 2008, we decided to form a company based upon Xenomis’ know how, science, business skills, etc. to market nutraceutical supplements based upon Resveratrol and Red Wine Grape polyphenols. I became the president of this new company — Vinomis Laboratories — and the quest began to market the highest quality nutraceutical supplement in the industry — and Vindure 900 was born. We launched the company in January 2009, and launched Vindure 900 in June 2009 to rave reviews. 

Sales have been brisk, and we are looking at myriad marketing channels to sell our products.

Blog Being Rebuilt

This Blog is being entirely rebuilt. One of our Competitor had my personal blog removed from Wordpress with bogus claims. Basically, this competitor does not want their name mentioned. Every time we mention it, they threaten to sue us, or do something nasty like lying about our blogs.

This competitor has taken my blog away from you, the consumer — but fear not, it will be back up and running in a matter of days. My Resveratrol Life blog will be under a new domain  www.vinomis.com/resveratrollife  or www.vinomis.com/startuplife

This is illegal and anti-competitive, restraint of trade, etc. The Truth in Advertising laws completely allow the mentioning of competitor information, so long as it is accurate. Think about it (Coke vs Pepsi, Cell Phone TV ads, Medical products ads) which all mention the competition. It is NOT a trademark infringement to mention a competitor’s name, products, features, fact and figures, etc., and we will continue to do so.

We will not be stopped in our quest to educate the market about the other Resveratrol and Red Wine grape products that don’t come close to including the ingredients.

We believe this was the post that caused our competitors to attack us as Vinomis Laboratories. This is the kind of thing that startups have to go through, when their competitors are “sleazy”. I have worked in the business-to-business world for 25 years, and these kinds of tactics aren’t generally used.

Do you see anything wrong with this blog post? It looks like straight up consumer information to me, gotten from product labels that we purchased as consumers.

Not to worry, Vinomis will live on and prosper, with new invigoration and competitive spirit.

  2. You must tell the truth

    Playing with Number

    Here’s a classic case of playing with numbers of Bottles or Glasses of red-wine equivalents with Shaklee’s Vivix product. A customer writes on the Vinomis Forum:

    “I recently found my way into a Shaklee representative’s internet portal for Shaklee nutritional products. The company says one dose is equivalent to 3000 glasses of red wine, and carries a cost of $99 per thirty day supply…”

    You are correct, according to the Shaklee website, ”A 30-day supply of Vivix delivers the equivalent amount of resveratrol found in 3,000 glasses of red wine.”

    But, that’s for a 30-DAY SUPPLY !!! 
    3,000 glasses per month = 100 glasses per day @ 1 mg per glass = 100 mg of Resveratrol per day, which if you read their website carefully is what they say.

    Vindure 900 is 400 mg per day = 100 bottles per 1 DAY = 500 glasses per day, or 15,000 glasses per 30 days. Any way you look at it, Vindure is 4x Shaklee’s daily dosage.

    And Vindure costs $39.95 per month.
